1. Service Overview

CheckCaseStatus.com ("Service", "Platform", "we", "us", or "our") is an immigration case management platform operated by KOL.XYZ LLC, registered in the State of Nevada, United States. Our service provides:

Core Features

• Case Status Check: Real-time query of USCIS immigration case status via the official USCIS Torch API, including case status text, descriptions, form type, and full history timeline.
• Case Monitoring & Alerts: Bookmark cases for automatic daily status checks. Receive email and in-app notifications when case status changes.
• AI-Powered Analysis: AI-generated case status interpretation, estimated processing timelines, and suggested next steps. All AI content is for informational purposes only and does NOT constitute legal advice.
• Multilingual Support: Full interface and AI analysis in English, Chinese (中文), and Spanish (Español).
• Multimodal Input: Text, image upload (USCIS notices), voice recording, and PDF text extraction.
• Developer API: RESTful API with OpenAPI 3.0 specification and MCP protocol support for third-party integrations.

Membership Tiers

• Free: Basic case status queries, 3 AI analysis trials, track up to 3 cases.
• Pro: Unlimited AI analysis, track up to 100 cases, batch case checking (up to 20 at once), PDF report export, email status change alerts, priority processing.

2. USCIS API Compliance

Our application uses the official USCIS Torch API in strict compliance with the USCIS API Terms of Use. We maintain the following technical and operational standards:

• OAuth 2.0 Authentication: Client Credentials grant type with all keys, secrets, and access tokens stored securely on our backend server infrastructure.
• Server-Side Only: All API requests to USCIS originate exclusively from our backend servers. No USCIS API credentials or tokens are exposed to client-side applications.
• HTTPS Error Handling: Comprehensive handling of all USCIS API response codes including structured error responses per RFC 9457 (Problem Details for HTTP APIs). Error messages are displayed to users in the front-end interface and logged on the backend.
• Rate Limiting: Intelligent rate limiting (20 requests per minute per user) and response caching to minimize unnecessary API calls to USCIS systems.
• Demo ID Support: API request headers support the demo_id parameter required for the USCIS production access review process, per RFC 2616 Section 5.3.
• Data Handling: USCIS API data (case status, descriptions, timelines) is displayed to authorized users only. Data is not sold, redistributed, or used for advertising.

3. Non-Affiliation & Trademarks

CheckCaseStatus.com is NOT affiliated with DHS, USCIS, or any U.S. government agency. We do not use the official seal, insignia, or visual identities of DHS, USCIS, or any government entity. The use of the term "USCIS" in our service is solely for descriptive purposes to indicate the source of case status data. Per 18 U.S.C. §§ 506, 701, 1017, unauthorized use of government seals and insignia is prohibited.

4. Account Registration

When registering for an account, you agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials. Do not share your login credentials with others.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized access.

Sharing or transferring accounts is prohibited. Each user must maintain their own individual account.

5. Acceptable Use

When using this Service, you agree NOT to:

• Use automated tools (scrapers, bots) to make bulk queries beyond the rate limits.
• Make requests exceeding normal usage rates (automatically rate-limited at 20 requests per minute per user).
• Resell, redistribute, or commercially exploit USCIS data obtained from this platform.
• Attempt to bypass security verification, authentication, or rate limiting mechanisms.
• Use this Service for any activity that violates U.S. federal or state law.
• Impersonate others or query cases without the case holder's authorization.
• Attempt to access USCIS API credentials, tokens, or keys stored on our servers.
• Use the Service to harass, abuse, or harm others.

6. Developer API Terms

If you access our Developer API (documented at /developers), the following additional terms apply:

• API keys are issued per application and must not be shared or exposed in client-side code.
• API requests are rate-limited to 20 requests per minute per key.
• You must not use the API to create a competing service that replicates our core functionality.
• You must display a clear disclaimer that your application is not affiliated with USCIS or any U.S. government agency.
• Your application must comply with the USCIS API Terms of Use, including all privacy and data handling requirements.
• We reserve the right to revoke API access for any violation of these terms.

7. Billing & Payments

• All payments are processed securely through Stripe, Inc. (PCI DSS Level 1 certified). We do not store credit card numbers on our servers.
• Subscriptions are billed according to the selected plan period and renew automatically unless canceled at least 24 hours before the end of the billing cycle.
• Prices are displayed in USD and include applicable descriptions of duration and features.
• You may cancel your subscription at any time from the Settings page or by contacting support.

8. Refund Policy

Due to the digital nature of our services, all purchases (subscriptions and one-time payments) are generally non-refundable. Exceptions:

• Technical errors (e.g., double billing, system errors): Contact support within 7 days for a full refund.
• Service unavailability exceeding 72 consecutive hours: Pro-rated refund for the affected period.

9. Intellectual Property

The Platform's user interface design, source code, AI analysis algorithms, branding, and all original content are intellectual property of KOL.XYZ LLC, protected by U.S. copyright and trademark law. USCIS case status data displayed on this Platform is sourced from the U.S. government and is in the public domain.

10. AI Content Disclaimer

AI-generated content on this Platform (case analysis, timeline predictions, next-step recommendations) is produced by third-party AI language models and is provided for informational purposes only. This content:

• Does NOT constitute legal advice, immigration counsel, or professional guidance of any kind.
• May contain inaccuracies, outdated information, or errors.
• Should not be the sole basis for any immigration-related decision.
• Is not a substitute for consultation with a qualified immigration attorney.

11. Limitation of Liability

This Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the fullest extent permitted by law, KOL.XYZ LLC is NOT liable for:

• USCIS API downtime, data delays, or data inaccuracies.
• Accuracy, completeness, or reliability of AI-generated analysis.
• Immigration decisions made based on information from this Platform.
• Third-party service interruptions (Stripe, Cloudflare, etc.).
• Loss of data due to circumstances beyond our reasonable control.

KOL.XYZ LLC's total aggregate liability shall not exceed the total amount you paid us in the preceding 12 months, or $100 USD, whichever is greater.

12. Termination & Account Closure

By Us: We reserve the right to suspend or terminate your account for violations of these Terms, abusive behavior, or suspected fraud. We will provide notice via email unless immediate action is required for security reasons.

By You: You may close your account at any time via the Settings page ("Delete Account") or by emailing support@checkcasestatus.com. Upon account closure:

• All personal data (profile, case bookmarks, AI chat history, uploaded files, notifications) will be permanently deleted within 30 days.
• Payment records will be retained for 7 years as required by U.S. financial regulations.
• You may request a data export (JSON format) before closing your account.

13. Data Security

We implement industry-standard security measures to protect your data:

• All USCIS API keys, OAuth secrets, and access tokens are stored exclusively on our backend server infrastructure.
• No API requests to USCIS originate from client applications.
• All data is transmitted via TLS 1.2+ encrypted connections (HTTPS).
• Sensitive data is encrypted at rest using AES-256 encryption.
• In the event of a data breach, we will notify affected users and relevant authorities as described in our Privacy Policy.

14. Accessibility

15. Governing Law

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict of law principles. Disputes shall first be resolved through good-faith negotiation. If unsuccessful within 30 days, disputes shall be submitted to the courts of competent jurisdiction in the State of Nevada.

16. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes:

• We will obtain your active consent via email or in-app notice.
• We will provide a plain-language summary of what has changed.
• Changes will include an effective date and will not apply retroactively.
